Terms and conditions of contract

• • • The tourist tax is not included and will be effective at the time of entry.
    • Check-in from 4:00 p.m. to 10:00 p.m. Departure until 11:00 a.m.
    • Any cancellation made up to 10 days before the arrival date will have a cost of €1 plus 4% of the amount charged and any bank costs that may arise from the cancellation.
    • Any cancellation made during the last 10 days before the arrival date will result in the loss of the amount paid at the time of booking (30% of the total stay). Failure to appear at the establishment on the scheduled day of arrival will result in the loss of 100% of the amount of the stay.
    • Any damage to the house or its contents will be charged to the same credit card with which the reservation payment was made.

General booking conditions

• • • These General Reservation Conditions (hereinafter General Conditions) will regulate the commercial relationship that arises between JELP 40 SL and the user or client for the contract made through the forms that JELP 40 SL makes available on its website www.maselcarrer.com.
    • The reservation through the websites of JELP 40 SL will imply the express acceptance, by the client or user of the pages, of these conditions, as well as the conditions of use established by the user’s navigation through the pages owned by JELP 40 SL.
    • These conditions will apply without prejudice to the application of the legal regulations on the matter that are applicable to each case.
    • The general contracting conditions regulate the distance selling relationship between JELP 40 SL and the user or client, in accordance with the legal stipulations, especially Law 7/1998, of April 13, on General Contracting Conditions, the Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of consumers and users, the current regulations on the Protection of Personal Data, Law 7/1996, of January 15 of Retail Trade Regulation and Law 34/2002 of July 11, on Information Society Services and Electronic Commerce.
    • JELP 40 SL reserves the right to make any modifications it deems appropriate, without prior notice, to the general conditions. These modifications may be made, through their websites, in any manner admissible by law and will be mandatory during the time they are published on the website and until they are validly modified by subsequent ones. However, JELP 40 SL reserves the right to apply, in certain cases, particular Contracting conditions in preference to these General Conditions when it considers it appropriate, announcing in a timely manner.

Prior booking information:

• • • JELP 40 SL informs you that the reservation procedure through its web pages is detailed in the corresponding section for formalizing the reservation.
      Likewise, JELP 40 SL informs that the user can have access to the conditions of use available on the same website.
    • By booking with JELP 40 SL through its website, the user or client expressly declares that they know, understand and accept these conditions of use and the general conditions. Likewise, the user declares that he or she is of legal age and has the legal and legal capacity necessary to access the JELP 40 SL websites and contract through them. The user is responsible for treating confidentially and responsibly the identity and password obtained when registering as a client, and may not transfer them to another.
    • Once the reservation is made, the user will see the reservation confirmation on the screen, and can print it as proof of the reservation made.
    • The reservation confirmation and the reservation receipt (printout made by the user) will not be valid as an invoice.

Reserve operation

Open reservations and price reference:

In compliance with current regulations and, especially Law 34/2002 on information society services and electronic commerce, JELP 40 SL offers in the corresponding section for formalizing the reservation information on all possible reservations, their features and prices. However, JELP 40 SL reserves the right to withdraw, replace or change the offers offered to its clients through its website, by simply changing their content. In this way, the products and/or services offered at all times by the JELP 40 SL website will be governed by the general conditions in force in each case. Likewise, the company will have the right to stop offering, without prior notice and at any time, access to said products and/or services.

Price indication:

• • • Each possible reservation offered will have its price indicated and whether it includes VAT or any other tax that, if applicable, is applicable. The prices indicated on the screen are those in force at all times except for typographical errors. When the price is different for the reason stated above, JELP 40 SL will inform the client, via e-mail, before proceeding to collect the reservation.
    • The tourist tax is not included in the reservation price and will be effective at the time of entry.
    • It will be necessary, if you have not made the reservation by credit card, to leave a credit card number to cover possible damage to the house and its contents or any type of theft.
    • For the reservation to be confirmed, it must be guaranteed through a valid credit card issued by a known banking entity (Visa, Mastercard and American Express credit cards are accepted).

Availability:

The availability of offers for JELP 40 SL through its website may vary depending on customer demand. Although JELP 40 SL updates the database periodically, the reservation requested by the client could be complete at that time. In this case, JELP 40 SL will send an e-mail to the client informing them of the impossibility of availability of the offer.

Payment methods:

JELP 40 SL requests, in reservations through its website, the details of a credit card, the reservation holder, to guarantee its effectiveness. The property will charge 30% of the reservation value to the credit card when making the reservation. The invoice corresponding to the reservation will be settled directly to the establishment, either in cash, by credit card or in any other way accepted by the establishment.

Reservation cancellation:

• • • Any cancellation made up to 10 days before the arrival date will have a cost of €1 plus 4% of the amount charged and any bank costs that may arise from the cancellation.
    • Any cancellation made during the last 10 days before the arrival date will result in the loss of the amount paid at the time of booking (30% of the total stay). Failure to appear at the establishment on the scheduled day of arrival will result in the loss of 100% of the amount of the stay.
    • If the user leaves the stay before the date until which it was reserved, the establishment may charge the full price of the services that remain to be used.

Change dates:

There will be no penalty as long as notice is given 10 days prior to the arrival date. Otherwise, what was agreed in the cancellation policy would apply.

Cancellation:

According to what is established in article 103 of Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of consumers and users, supplies of services or goods made in accordance with specifications of the consumer or clearly personalized, or that, due to their nature, cannot be returned or may deteriorate or expire quickly, are exempt from withdrawal.

Number and identity of clients:

• • • Clients must provide the number and identity of those who will occupy the apartment.
    • No more people than stipulated in the contract will be allowed.
    • The client is informed that the data they provide us through the contact form will be used to respond to their requests for information and service.
    • Likewise, they may be used to send information, offers and news about our apartments.
    • At any time, you may exercise your rights of access, rectification, cancellation and opposition by directing your request to the following address: SANT JOSEP ORIOL STREET, 7 – LA FLORESTA – 08198 SANT CUGAT DEL VALLÈS (BARCELONA).

Arrivals and departures:

• • • Check-in time is Monday to Sunday, from 4 to 10 p.m. Outside of these hours, the establishment must be notified in sufficient time for good organization.
    • Check-out time from the apartments must be before 11 am. You must be notified in advance of the expected departure time to inspect the apartment and, if applicable, the deposit will be returned.

Supplies and equipment:

• • • Sheets and towels corresponding to the number of occupants of the apartment are included in the initial inventory.
    • The kitchen is equipped with standard cooking utensils.
    • The supply of water and electricity is included in the price.
    • Free WI-FI (IMPORTANT: the wifi comes to us via satellite and is distributed among all apartment clients. We cannot always guarantee a stable connection).

Laundry service:

The apartments have a communal laundry service (washing machine and dryer).

Cleaning:

• • • The apartments are delivered clean.
    • Daily maintenance cleaning is the responsibility of the tenant.
    • If on the day of departure the apartment is not in proper condition, in terms of cleaning, the amount of cleaning will be deducted from the deposit.

Responsibilities:

• • • The establishment is not responsible for any damages that may occur as a result of your stay in the apartment, including theft or fire.
    • The establishment is also not responsible for personal and valuable items that clients keep in the apartments, nor for damage or theft to vehicles found in the parking lot, if applicable.
    • The establishment is not responsible for lost or forgotten objects once the client has checked out, but will try to facilitate their recovery and location.

Conduct:

• • • The client will be responsible for his own behavior and that of those accompanying him.
    • If your behavior is not in accordance with minimum standards of coexistence, the establishment may demand that you leave the apartment without the right to a total or partial refund of the remaining days, or any compensation.

Supplement per person:

• • • No greater occupancy will be allowed than the places assigned to each apartment, which are: 2-bedroom apartment (1 extra in a double room) and 3-bedroom apartment (1 extra in a double room).
    • Each additional person has an additional cost of 23 euros per person per night. Only one child under 3 years old is exempt from the supplement.

Pets:

Pets are allowed. In this case, a supplement of €10/night/pet will be charged. In shared outdoor spaces (garden, pool, barbecues…), pets must be leashed. No more than 2 animals per apartment are allowed.

Data protection

In accordance with current and applicable regulations on the protection of personal data, we inform you that your data will be incorporated into the processing system owned by JELP 40 SL with CIF B65399404 and registered office located at SANT JOSEP ORIOL STREET, 7 – LA FLORESTA – 08198 SANT CUGAT DEL VALLÈS (BARCELONA), and their respective purposes, conservation periods and legitimizing bases are listed below. For those treatments that require it, you are also informed of the possible creation of profiles and automated decisions, as well as the possible assignments and international transfers that JELP 40 SL plans to carry out:

Applicable legislation and jurisdiction

Likewise, JELP 40 SL reserves the right to file civil or criminal actions that it deems appropriate for the improper use of its website and content or for non-compliance with these conditions.

The relationship between the user and the lender will be governed by the regulations in force and applicable in Spanish territory. If any controversy arises, the parties may submit their conflicts to arbitration or resort to ordinary jurisdiction, complying with the rules on jurisdiction and competence in this regard.
